I understand and accept that the availability of the information and guidance as part the Website does not constitute a recommendation by HDFC ERGO to Buy any /products/ and or to avail any services and I shall do my own due diligence before deciding to avail any of the services available on the Website .

I understand and I confirm that the Website is solely provided for the sake of convenience and to provide a “wellbeing assessment report” and related helpful information, including but not limited, to connecting me Wellbeing Service Providers. The Survey and facilities on the Website are only facilitated by HDFC ERGO. I understand and confirm that HDFC ERGO cannot be held liable for any defect or deficiency in service by any of the vendor providing the Services through Website/ Wellbeing Service Providers.

I am aware and accept that all information, content, materials, products (including, but not limited to text, content, photographs, graphics, video and audio content) on the Website is protected by Intellectual Property Law and are registered (wherever applicable) in favour of HDFC ERGO and is also protected otherwise under general intellectual property law. I also understand that all the information, content, material, products (including, but not limited to text, content, photographs, graphics, video and audio content) on the respective Wellbeing Service Provider’s platform (diverted through the Website) is protected by Intellectual Property Law and are registered (wherever applicable) in favour of the respective Wellbeing Service Provider.

I am aware that theassessment integrated in thehabitoflife.com- the Panchkosha Wellbeing Assessment (www.panchkoshawellbeing.in) is the joint Intellectual Property of IIT-Bombay and HDFC ERGO. I will not copy / duplicate / download the assessment as a whole or any questions thereof. The personal assessment report generated for me or my ward is only for private viewing and will not be uploaded on any public forum.I understand that all the data provided under this Survey shall be stored in the local servers of HDFC ERGO in India.Further, the limited non-identifiable information shall be stored with IIT Bombay for the purposes of data analytics etc.

Upon my consent on the Website, I agree to being contacted by HDFERGO or any other Wellbeing Service Providers with whom HDFC ERGO has entered into an arrangement for providing the aforementioned .. HDFC ERGO shall protect all such information and the same shall be utilised strictly in accordance with the Privacy Policy.
I am aware that the Survey on the Website may require to access products, services including websites, links, mobile applications and the content, material, etc therein from third parties and may also help me to find, request, interact with Third parties including Service Providers with whom I may share my data including my personal and sensitive information to avail certain services. Such Service Provider/s may store the content, information provided by me for providing the Services. I will review the same , agree and accept their terms including privacy policy and I shall be responsible for any and all the dealing with them. I agree that Website or the WELLBEING Service Provider shall not be liable for any loss of data on account of any event which is outside the control of HDFC ERGO or the respective Wellbeing Service Provider, as the case may be. I agree there is no guarantee or warranty that the site is free from any virus or other malicious, destructive or corrupting code, program or macro.

I agree that there is no guarantee or warranty that there will be uninterrupted access to and/or use of the Website and the contents therein /Payment and delivery Mechanism.

I understand and accept that not all the products and survey offered on this Website are available in all geographic areas and I may not be eligible for all the products or survey offered by the Website. The Website/HDFC ERGO reserves the right to determine the availability and eligibility of any product or survey.

HDFC ERGO does not make any warranties, and expressly disclaims all warranties express or implied, including without limitation, those of merchantability and fitness for a particular purpose, title or non-infringement with respect to any information or survey or products including the Wellbeing Assessment Report that are available or on the Website through these third party websites/ Wellbeing Service Providers and HDFC ERGO is not liable or responsible for the same. You are advised to check the authenticity and originality of the products and Services offered through such individuals/ entities.
I acknowledge and understand that my personal and sensitive data shall also be governed by the terms and conditions including the privacy policy of the respective Wellness Service Provider as and when I decide to access the website or mobile application of such Wellbeing Service Providers and/ or choose to avail such Services. I also acknowledge and understand that my accepting such terms and conditions and/ or usage of my personal and sensitive information by such Wellbeing WELLBEING Service Provider/s, HDFC ERGO cannot be held responsible in any manner whatsoever.
HDFC ERGO/the Website shall not be liable if any transaction does not fructify or may not be completed or for any failure on part of the Wellbeing Service Provider to perform any of its obligations under these terms and conditions or those applicable specifically to its services/facilities if performance is prevented, hindered or delayed by a Force Majeure event (defined below) and in such case its obligations shall be suspended for so long as the Force Majeure event continues.

“Force Majeure Event” means any event due to any cause beyond the reasonable control of the Company, including without limitations, unavailability of any communication systems, breach, or virus in the processes or payment or delivery mechanism, sabotage, fire, flood, explosion, acts of god, pandemic, epidemic, civil commotion, strikes or Industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorised access to computer data and storage devices, computer crashes, malfunctioning in the computer terminal or the systems getting affected by any malicious, destructive or corrupting code or program, mechanical or technical errors/failures or power shut down, faults or failures in telecommunication etc.

I agree and accept that the protection of the Customer Id and the Customer/Transaction Passwords is my sole responsibility and I shall ensure that the password/s is/are not revealed to any third party and I shall not hold HDFC ERGO responsible for any misuse mistake / error thereof. In the event that any third parties uses the Customer Id and Customer /Transaction Password, in the event of any such misuse, damage, claims arising therefrom I agree to indemnify and keep indemnified and hold harmless HDFC ERGO against any such Liability, costs or damages arising out of claims or suits by or against such third parties based upon or relating to such access and use.
